The Givon Detention Review Tribunal, also known as the Ramla Detention Review Tribunal, is located at the Givon Detention Facility near Ayalon Prison in Ramla. This tribunal serves as the designated authority for undocumented individuals arrested by the Immigration Police<\/a> and held at the Givon Detention Facility.<\/p>\n

Our law office represents clients in status regularization procedures before the Ministry of Interior and the immigration authorities in Israel. In this article, Attorney Joshua Pex explains the circumstances under which a detainee held in custody for lacking legal documentation or legal status in Israel can request release.<\/p>\n

Arrest by the Immigration Police and Transfer to a Detention Facility<\/strong><\/p>\n

An arrest by the Immigration Police (the colloquial term for the enforcement unit of the Ministry of Interior) involves detaining undocumented individuals or those without legal status in Israel. The Immigration Police do not arrest asylum seekers or undocumented individuals for violations of Israeli law unrelated to immigration matters.<\/p>\n

Israel’s immigration authorities strive to minimize the number of undocumented residents or so-called “infiltrators”. To maintain oversight, the state endeavors\u2014though not always successfully\u2014to keep an accurate count of how many asylum seekers<\/a> or stateless individuals are within its borders and their exact location.<\/p>\n

While it is relatively straightforward to track the number of undocumented individuals in Israel based on records of tourists or workers who entered the country but overstayed their visas, significant enforcement of immigration policy and deportation of these illegal aliens proves more challenging. Practical constraints (such as limited manpower) and legal obstacles (including international agreements or difficulties in executing deportations) often hinder the removal of undocumented individuals from Israel.<\/p>\n

\"Ramla<\/p>\n

Some Israeli citizens, including politicians and members of organizations representing residents of southern Tel Aviv, argue that unregulated asylum seekers pose a national problem and contribute to increased crime rates in neighborhoods where they reside. They therefore pressure the government to expedite their deportation.<\/p>\n

In any case, the Immigration Police conduct enforcement operations, detaining individuals found in Israel without valid permits, whether because they failed to apply for one or because they allowed their permit to expire without renewal. Immigration Police investigate suspected undocumented residents, request documentation when doubts arise, and have the authority to detain those found without legal status. Once detained, these individuals are transferred to a detention facility, pending approval from a Ministry of Interior immigration officer.<\/p>\n

Release from Detention: Not Always the End of the Line<\/strong><\/p>\n

Being detained as an undocumented resident does not necessarily mean “the end of the road.” Errors can occur\u2014valid documents may not have been received, or missing paperwork may result from accidental loss or other reasons. Over the years, there have been numerous legal precedents where detainees were released from custody at a detention facility before being deported from Israel.<\/p>\n

Expert Immigration Lawyer \u2013 Releasing Undocumented Detainees from Custody<\/strong><\/p>\n

Certain lawyers specialize in this field, and thanks to their expertise, legal knowledge, and extensive experience accumulated over the years, they know precisely how to assist undocumented individuals held in custody during deportation proceedings back to their country of origin.<\/p>\n

This tribunal serves as an appellate body for decisions made by the Detention Review Tribunal in Ramla and grants the right to appeal decisions made by the Ministry of Interior<\/a>.
